The initial questions and observations<\/a> of the judges don’t sound good for the prospect of ObamaCare, but that’s by no means an indicator of how they’ll vote. One analyst I heard said that this ruling, whatever it is, may wind up being the law of the land. If the case goes to the Supreme Court, Justice Kagan will, or should, recuse herself<\/a>, as she was instrumental in crafting the legal defense of ObamaCare itself.
