It&#8217;s now open season on laws that state administrations don&#8217;t like. <a href=\"http:\/\/www.washingtonpost.com\/blogs\/post-politics\/wp\/2013\/07\/11\/sources-pa-attorney-general-wont-defend-states-gay-marriage-ban\/\">Exhibit A.<\/a><\/p>\n<blockquote>\n<p>Pennsylvania attorney general Kathleen Kane announced Thursday afternoon she will not defend the state in a federal lawsuit filed this week challenging the constitutionality of the state\u2019s ban on same-sex marriage, calling the prohibition \u201cwholly unconstitutional.\u201d<\/p>\n<\/blockquote>\n<p>Who promoted her to judge? Whether or not it\u2019s unconstitutional is not her call to make. The Attorney General represents the state and defends its laws; <i>all<\/i> of the state and <i>all<\/i> of its laws. <\/p>\n<p>If a state Attorney General refuses to defend those laws, that\u2019s an abdication of his or her primary responsibility; their oath of office. AGs do <i>not<\/i> (or at least <i>should <\/i>not) have this prerogative. Otherwise you\u2019ll have one set of laws when one administration is in power, and another set for another administration. <\/p>\n<p>The Supreme Court said that they\u2019re leaving it up to the states to decide what marriage is.
